1. Federal Law Notice (Mandatory Language — 26 CFR 301.7216-3)
Federal law requires this consent form be provided to you. Unless authorized by law, we cannot use, without your consent, your tax return information for purposes other than the preparation and filing of your tax return.
You are not required to complete this form to engage our tax return preparation services. If we obtain your signature on this form by conditioning our tax return preparation services on your consent, your consent will not be valid.
Your consent is valid for the amount of time that you specify. If you do not specify the duration of your consent, your consent is valid for one year from the date of signature.
2. Statutory Basis and Penalties
This consent is governed by Internal Revenue Code §7216 (a criminal misdemeanor for the knowing or reckless unauthorized disclosure or use of tax return information, punishable by up to $1,000 and one year imprisonment per offense), §6713 (a civil penalty), and Treasury Regulation 26 CFR 301.7216, together with IRS Revenue Procedure 2013-14 (and successor guidance).
Tax Wallet Inc. and each participating tax office maintain policies to comply with these provisions.
3. Consent to USE Tax Return Information
You authorize TaxWallet and your preparer (the tax office using the platform) to use your tax return information beyond preparing and filing your return for:
- Determining eligibility for, and offering, refund transfers, refund advances, and other bank products;
- Providing, personalizing, and improving platform features, including automated document processing and AI-assisted preparation and review (the “Justin” assistant);
- Offering related tax, renewal, and financial services for which you may be eligible;
- Customer support and account communications.
You may decline any specific use in writing without affecting preparation of your return.
4. Consent to DISCLOSE Tax Return Information
You authorize disclosure of your tax return information, limited to what is reasonably necessary, to:
- Banking and refund-transfer partners, to enroll and administer bank products;
- Payment processors, to process fees you authorize;
- Identity-verification and fraud-prevention providers (KYC/AML);
- Service providers who host, secure, or operate the platform under written confidentiality and data-protection obligations consistent with the GLBA Safeguards Rule (16 CFR Part 314).
5. Duration
Unless you specify a shorter period at signing, this consent is valid for the applicable tax season and up to one (1) year from the date of signature, consistent with 26 CFR 301.7216-3(b)(5).
6. Voluntary; Right Not to Consent
Signing is voluntary. We will prepare and file your return whether or not you sign. If you do not sign, we will not use or disclose your information for the purposes above, and certain optional products (e.g., refund transfers or advances) may be unavailable as a result. Consent is not a condition of preparation.
7. Copies and Revocation
You are entitled to a copy of this consent at signing and on request. You may revoke prospectively by written notice to support@taxwallet.ai; revocation does not affect uses or disclosures already made in reliance on your consent.
8. Reporting a Concern (Mandatory Notice)
If you believe your tax return information has been disclosed or used improperly in a manner unauthorized by law or without your permission, you may contact the Treasury Inspector General for Tax Administration (TIGTA) by telephone at 1-800-366-4484, or by email at complaints@tigta.treas.gov.
9. Electronic Signature
You may consent electronically under the ESIGN Act (15 U.S.C. §7001). Your electronic signature is captured with timestamp, signer identity, and device/IP, consistent with our Electronic Signature Disclosure & Consent.
