1. Who We Are
TaxWallet is operated by Tax Wallet Inc., a Florida corporation (Florida Document No. P23000077808). TaxWallet is a technology provider. Tax returns filed through TaxWallet are prepared by independent tax professionals, who are responsible for them (Section 2 of the Terms of Service). Bank products are offered by the issuing bank.
2. How to Send a Legal Notice
Send legal notices, including any Notice of Dispute, subpoena correspondence or demand, by email to legal@taxwallet.ai. TaxWallet will provide a mailing address for formal legal notice on request.
Copyright notices go to the same address under our Copyright & DMCA Policy. To opt out of arbitration under Section 18.2 of the Terms of Service, email legal@taxwallet.ai as that Section describes. Account, billing and privacy requests go to support@taxwallet.ai.
3. Notice Before Any Claim
Users of TaxWallet have agreed, in Section 13 of the Terms of Service, that before filing any lawsuit or arbitration against TaxWallet they will send a written Notice of Dispute to legal@taxwallet.ai (with their name, account, the facts, the relief they want and their contact details) and then negotiate in good faith for 30 days. Time limits are paused during those 30 days.
Sending a Notice of Dispute is not an arbitration opt-out, and it does not shorten the 30-day opt-out period in Section 18.2.
4. How Disputes Are Resolved
Disputes with users are resolved under the Terms of Service, under Florida law:
- Consumers (individuals using TaxWallet for personal purposes, including taxpayers) resolve disputes by individual arbitration with the American Arbitration Association, unless they opt out, with small-claims court available (Section 18, Part A). Each side pays its own attorneys’ fees, except where a claim is found frivolous or brought for an improper purpose, and any right the law gives a Consumer to recover fees is kept (Section 16.1).
- Business Customers (offices, preparers, service bureaus, partners and developers) resolve disputes only in the state or federal courts in Miami-Dade County, Florida, with jury trial waived and attorneys’ fees to the prevailing party (Sections 15, 16.2, 16.3 and 18.10).
5. How TaxWallet Responds to Claims
TaxWallet answers every proper notice and works in good faith to resolve disputes. TaxWallet also defends itself against claims that have no legal or factual basis. Where the Terms of Service or the law allow, TaxWallet will seek its attorneys’ fees and costs, and, for claims found frivolous, sanctions under the applicable rules, including section 57.105, Florida Statutes. For Consumers, this is limited to what Section 16.1 of the Terms of Service allows.
