1. Purpose of This Disclosure
This Refund Transfer & Banking Partner Disclosure (“Disclosure”) governs all refund transfer products, advance loans, settlement services, banking integrations, and financial features accessed through TaxWallet (“Company”, “we”, “our”).
TaxWallet is NOT a bank, lender, financial institution, money transmitter, or guarantor of any refund-based product. All financial products are processed exclusively through independent, federally regulated banking partners.
By using any banking or refund transfer module, you acknowledge that you have read, understood, and unconditionally agree to this Disclosure.
2. TaxWallet Is Not a Bank or Financial Institution
TaxWallet does NOT:
- Approve, deny, or fund refunds or advance loans,
- Determine eligibility for refund transfers,
- Handle, custody, or move taxpayer funds,
- Guarantee timing or accuracy of disbursements,
- Provide financial, lending, or investment advice.
TaxWallet acts solely as a software facilitator and secure messaging/documentation platform between tax professionals and their banking partners.
3. Independent Banking Partners
Refund transfers and advance products are provided exclusively by third-party regulated financial institutions, including but not limited to:
- Pathward®, National Association (formerly MetaBank®),
- EPS Financial, a Division of Pathward,
- Santa Barbara TPG, Green Dot Bank affiliates,
- Refundo, River City Bank, Republic Bank, or other approved partners.
These institutions operate independently and maintain their own compliance, underwriting, approvals, risk systems, fraud checks, and funding timelines.
TaxWallet has no authority to override, expedite, reverse, or influence a banking partner’s decision.
4. Eligibility Determinations
Eligibility for banking products is determined solely by the banking partner and may depend on:
- IRS refund availability and verification,
- Identity verification results (SMS, email, biometric, KBA, or device match),
- Fraud screening outcomes,
- EFIN standing, preparer eligibility, and compliance indicators,
- Return type, filing status, and IRS data-match results.
TaxWallet does not review, assess, or guarantee eligibility.
5. IRS Refund Timing, Holds & Offsets
Users acknowledge the IRS may delay, intercept, or reduce a refund for reasons including:
- Identity verification holds,
- Error resolution, manual review, or audit,
- Debts owed (child support, student loans, state taxes),
- Suspicious activity or mismatched taxpayer information.
TaxWallet is not responsible for any delay, reduction, or withholding of funds by the IRS or state agencies.
6. Banking Partner Delays, Errors & Funding Issues
Banking partners may delay disbursements for reasons including:
- Identity verification discrepancies,
- EFIN review or preparer compliance checks,
- Fraud alerts flagged by the bank, IRS, or TaxWallet,
- Incorrect routing or account information provided by the user,
- System outages, ACH delays, bank holidays.
TaxWallet bears no liability for:
- Delayed funding,
- Declined products,
- Rejected refund transfers,
- Bank processing errors.
All inquiries related to bank decisions must be directed to the relevant financial institution.
7. Fees Associated with Refund Transfers
Refund transfer products may include fees determined solely by the banking partner, including:
- Refund Transfer fees,
- Preparer fees (where allowed),
- Additional product or technology fees,
- Ancillary compliance or fraud prevention fees.
TaxWallet does not control, adjust, or refund banking partner fees.
Tax professionals must disclose fees to their clients as required by law.
8. TaxWallet’s Technical Role in Banking Integrations
TaxWallet’s role is strictly limited to:
- Securely transmitting banking application data,
- Displaying banking partner statuses, decisions, and messages,
- Allowing tax professionals to enable or disable banking products,
- Delivering disclosures and consent forms electronically.
TaxWallet does NOT:
- Process refund transfer settlements,
- Hold or access taxpayer refund funds,
- Communicate directly with banking underwriters on your behalf.
9. Fraud Prevention & Identity Verification
TaxWallet may require additional verification, including:
- SMS one-time codes,
- Email verification,
- Mobile app device binding and device ID creation,
- Biometric checks (selfie vs ID match),
- Knowledge-Based Authentication (KBA).
Failure to complete verification may result in:
- Product ineligibility,
- Filing delays,
- Banking partner rejection.
TaxWallet reserves the right to deny platform access or freeze activity if fraud is suspected.
10. No Guarantees of Refund Amount or Disbursement Type
TaxWallet does not guarantee:
- The amount of a refund,
- Eligibility for refund transfer products,
- Timing of bank payouts or IRS funding,
- Accuracy of refund estimates generated in the software.
Only the IRS and state agencies determine the final refund amount.
11. Liability Limitations
To the maximum extent permitted by law, TaxWallet is not liable for:
- Banking errors,
- ACH delays,
- Incorrect taxpayer bank information,
- Refund reductions due to IRS offsets,
- Failed or canceled refund transfer products,
- Taxpayer disputes with banking partners or preparers.
Users and tax professionals agree to indemnify and hold harmless TaxWallet for any financial loss arising from refund transfers or banking partner actions.
12. Data Handling, Encryption & Storage
Banking application data is encrypted end-to-end and stored only as required for compliance.
TaxWallet does not store full credit card CVV numbers, though encrypted cardholder data may be stored for future billing (as permitted by the user).
Device identifiers, session tokens, and audit logs may be created to secure banking workflows.
13. Merchant Account & Payment Gateway Integrations
If a tax professional connects a merchant account (e.g., Authorize.net, IntellyPay, PaySafe):
- TaxWallet acts ONLY as a secure proxy for transmitting payment information,
- TaxWallet is NOT responsible for fraud, chargebacks, disputes, or processor errors,
- All financial responsibility rests with the tax professional and merchant processor,
- Refunds, disputes, and fees are handled directly with the payment processor.
14. Changes, Updates & Amendments
TaxWallet may update this Disclosure at any time.
Material updates may be provided via email, dashboard alerts, or in-app messaging.
Continued use of refund transfer modules after updates constitutes acceptance of revised terms.
